Le 13 avril, la Commission européenne (CE) a publié une nouvelle décision d'exécution énumérant de nouvelles références aux normes harmonisées pour les machines à l'appui de la directive 2006/42/CE.
En 2021, le CECE a envoyé deux lettres à la CE concernant l'amendement de la norme EN 474-1:2006+A6:2019 sur les engins de terrassement. La première lettre demandait une citation rapide de cet amendement, que le CEN avait déjà publié en 2019. La deuxième lettre réagissait à la citation de cette norme au Journal officiel de l'Union européenne (JOUE) le 14 octobre 2021, nos membres ont identifié deux problèmes qu'il fallait régler : l'absence d'une période transitoire et réadresser l'avertissement accompagnant la citation.
Cette nouvelle décision d'exécution de la CE corrige et adapte la citation précédente pour répondre aux préoccupations du CECE. Elle ajoute deux notes sous EN 474-1:2006+A6:2019 clarifiant quelles parties de la norme ne fournissent pas de présomption de conformité à Visibilité - Champ de vision de l'opérateur et Attaches rapides. Spécifiquement:
Avis 1 : Cette publication ne concerne pas la clause 5.8.1 Visibilité - Champ de vision de l'opérateur de cette norme, mais uniquement en relation avec les exigences EN 474-5:2006+A3:2013 pour les pelles hydrauliques, dont l'application ne confère pas un présomption de conformité aux exigences essentielles de santé et de sécurité 1.2.2 et 3.2.1 de l'annexe I de la directive 2006/42/CE.
Avis 2 : En ce qui concerne l'Annexe B.2 – Attaches rapides, la norme harmonisée EN 474-1:2006+A6:2019 ne confère pas de présomption de conformité aux exigences essentielles de santé et de sécurité 1.1.2 b), 1.1.2 c) et 1.3.3 de l'annexe I de la directive 2006/42/CE lorsqu'ils sont appliqués en combinaison avec les exigences EN 474-4:2006+A2:2012 pour les chargeuses-pelleteuses et les exigences EN 474-5:2006+A3:2013 pour les pelles hydrauliques .
En outre, la décision d'exécution introduit une période transitoire pour l'application de la norme EN 474-1:2006+A5:2018. Par conséquent, la CE a republié la référence à la norme EN 474-1:2006+A5:2018 au JOUE pour une durée limitée. Pour des raisons de sécurité juridique, la CE informe que la publication de la référence à la norme harmonisée EN 474-1:2006+A5:2018 devrait également couvrir la période précédant l'entrée en vigueur de la présente décision.
Les membres du CECE sont satisfaits de cette nouvelle décision, car elle apportera une clarté concernant les notes au JOUE et une période de transition équitable entre les amendements 5 et 6. En pratique, EN 474-1:2006+A5:2018 donne une présomption de conformité à partir du 15 Octobre 2021 au 11 octobre 2022.

On 13th April, the European Commission (EC) published a new implementing decision listing new references to harmonized standards for machinery in support of Directive 2006/42/EC.
Back in 2021, CECE sent two letters to the EC about the amendment of EN 474-1:2006+A6:2019 on Earth-moving machinery. The first letter asked for a prompt citation of this amendment, which CEN published already in 2019. The second letter reacted to the citation of this standard in the Official Journal of the European Union (OJEU) on 14th October 2021, our members identified two issues that needed to be addressed: a lack of a transitional period and readdress the warning accompanying the citation.
This new EC implementing decision corrects and adapts the previous citation to address CECE’s concerns. It adds two notes under EN 474-1:2006+A6:2019 clarifying which parts of the standard do not provide presumption of conformity to Visibility – Operator’s field of view and Quick couplers. Specifically:
Notice 1:This publication does not concern clause 5.8.1 Visibility – Operator's field of view of this standard, but only in relation with EN 474-5:2006+A3:2013 requirements for hydraulic excavators, the application of which does not confer a presumption of conformity to the essential health and safety requirements 1.2.2 and 3.2.1 of Annex I to Directive 2006/42/EC.
Notice 2: With regards to Annex B.2 – Quick couplers, the harmonized standard EN 474-1:2006+A6:2019 does not confer a presumption of conformity to the essential health and safety requirements 1.1.2 b), 1.1.2 c) and 1.3.3 of Annex I to Directive 2006/42/EC when applied in combination with EN 474-4:2006+A2:2012 requirements for backhoe loaders and EN 474-5:2006+A3:2013 requirements for hydraulic excavators .
In addition, the implementing decision introduces a transitional period for the application for EN 474-1:2006+A5:2018. Therefore, the EC republished the reference to EN 474-1:2006+A5:2018 in the OJEU for a limited time period. For reasons of legal certainty, the EC informs that the publication of the reference to harmonized standard EN 474-1:2006+A5:2018 should also cover the period prior to the entry into force of this Decision.
CECE members are satisfied with this new decision, as it will provide a clarity regarding the notes in the OJEU and fair transition period between amendments 5 and 6. In practice, EN 474-1:2006+A5:2018 gives presumption of conformity from 15th October 2021 to 11th October 2022.

Op 13 april heeft de Europese Commissie (EC) een nieuw uitvoeringsbesluit gepubliceerd met nieuwe verwijzingen naar geharmoniseerde normen voor machines ter ondersteuning van Richtlijn 2006/42/EG.
In 2021 stuurde CECE twee brieven naar de EC over de wijziging van EN 474-1:2006+A6:2019 over grondverzetmachines. De eerste brief vroeg om een snelle citatie van deze wijziging, die CEN al in 2019 publiceerde. De tweede brief reageerde op de citatie van deze norm in het Publicatieblad van de Europese Unie (OJEU) op 14 oktober 2021, onze leden identificeerden twee problemen dat moest worden aangepakt: het ontbreken van een overgangsperiode en het aanpassen van de waarschuwing bij de aanhaling.
Dit nieuwe uitvoeringsbesluit van de EG corrigeert en past het vorige citaat aan om de zorgen van CECE weg te nemen. Het voegt twee opmerkingen toe onder EN 474-1:2006+A6:2019 om te verduidelijken welke delen van de norm geen vermoeden van overeenstemming bieden met Zichtbaarheid – gezichtsveld van de operator en snelkoppelingen. specifiek:
Opmerking 1: Deze publicatie heeft geen betrekking op clausule 5.8.1 Zichtbaarheid – gezichtsveld van de machinist van deze norm, maar alleen in verband met de eisen van EN 474-5:2006+A3:2013 voor hydraulische graafmachines, waarvan de toepassing geen vermoeden van overeenstemming met de essentiële gezondheids- en veiligheidseisen 1.2.2 en 3.2.1 van bijlage I bij Richtlijn 2006/42/EG.
Opmerking 2: Met betrekking tot bijlage B.2 – Snelkoppelingen, geeft de geharmoniseerde norm EN 474-1:2006+A6:2019 geen vermoeden van overeenstemming met de essentiële gezondheids- en veiligheidseisen 1.1.2 b), 1.1.2 c) en 1.3.3 van bijlage I bij Richtlijn 2006/42/EG indien toegepast in combinatie met EN 474-4:2006+A2:2012 eisen voor graaflaadmachines en EN 474-5:2006+A3:2013 eisen voor hydraulische graafmachines .
Daarnaast introduceert het uitvoeringsbesluit een overgangsperiode voor de toepassing van EN 474-1:2006+A5:2018. Daarom heeft de EC de verwijzing naar EN 474-1:2006+A5:2018 opnieuw gepubliceerd in het PBEU voor een beperkte periode. Om redenen van rechtszekerheid deelt de EC mee dat de publicatie van de verwijzing naar de geharmoniseerde norm EN 474-1:2006+A5:2018 ook betrekking moet hebben op de periode voorafgaand aan de inwerkingtreding van dit besluit.
CECE-leden zijn tevreden met dit nieuwe besluit, aangezien het duidelijkheid zal verschaffen over de toelichtingen in het PBEU en een eerlijke overgangsperiode tussen amendementen 5 en 6. In de praktijk geeft EN 474-1:2006+A5:2018 een vermoeden van conformiteit vanaf de 15e oktober 2021 tot 11 oktober 2022.
